DeskSmash Terms of Use
These Terms of Use govern your use of DeskSmash, a macOS application developed by Yigit Arslan. By downloading, installing, or using DeskSmash, you agree to these terms.
1. Use of the App
DeskSmash is provided for personal entertainment and productivity-break purposes. You may use the app only in compliance with applicable laws and these terms.
You may not use DeskSmash in a way that:
- violates applicable laws or regulations;
- interferes with the normal operation of your device or another person's device;
- attempts to copy, resell, sublicense, reverse engineer, decompile, or modify the app, except where such restrictions are not permitted by law.
2. License
DeskSmash is licensed, not sold. Subject to these terms, you are granted a limited, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, in accordance with Apple's platform rules.
All rights not expressly granted are reserved by the developer.
3. App Functionality
DeskSmash creates temporary visual and audio effects as a desktop overlay. It is designed for playful use and does not permanently alter your files or desktop contents under normal operation.
Some tools in the app depict stylized, non-realistic effects, including fictional or cartoon-like destruction elements. These are purely visual effects intended for entertainment and do not represent real-world behavior or consequences.
App behavior may vary depending on your macOS version, system configuration, hardware, display setup, permissions, and other installed software.
4. No Warranty
DeskSmash is provided on an "as is" and "as available" basis, without warranties of any kind, except where warranties cannot be excluded under applicable law.
The developer does not guarantee that the app will be uninterrupted, error-free, or compatible with all devices or future macOS versions.
5. Limitation of Liability
To the maximum extent permitted by law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, goodwill, or business opportunities arising out of or related to your use of DeskSmash.
If applicable law does not allow certain limitations, some of the above may not apply to you.
6. User Responsibility
You are responsible for using DeskSmash in a safe and reasonable manner. Do not use the app in situations where distraction, sound, or visual effects could create risk, damage, or disruption.
DeskSmash is intended for entertainment purposes only and should not be interpreted as encouraging real-world actions.
7. Updates and Changes
The developer may update, modify, suspend, or discontinue DeskSmash at any time, with or without notice.
These Terms may also be updated from time to time. Continued use of the app after changes take effect constitutes acceptance of the updated terms.
8. Privacy
Your use of DeskSmash is also subject to the DeskSmash Privacy Policy.
9. Termination
These terms remain in effect until terminated. They will terminate automatically if you fail to comply with them. You may also stop using the app at any time by uninstalling it.
10. Governing Law
These terms are governed by the laws of the Federal Republic of Germany, excluding conflict of laws rules, unless mandatory consumer protection laws in your country of residence provide otherwise.
