DeskPlay Terms of Use
These Terms of Use govern your use of DeskPlay, a macOS application developed by Yiğit Arslan. By downloading, installing, or using DeskPlay, you agree to these Terms.
1. Use of the App
DeskPlay is provided for personal entertainment, creative play, and short productivity-break purposes. You may use the app only in compliance with applicable laws, Apple's platform rules, and these Terms.
You may not use DeskPlay in a way that:
- violates applicable laws or regulations;
- interferes with the normal operation of your device or another person's device;
- causes disruption, harassment, or misuse in shared, public, work, school, or presentation environments;
- attempts to copy, resell, sublicense, reverse engineer, decompile, modify, or redistribute the app, except where such restrictions are not permitted by law.
2. License
DeskPlay is licensed, not sold.
Subject to these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to use DeskPlay on devices you own or control, in accordance with Apple's applicable platform rules.
All rights not expressly granted are reserved by the developer.
3. App Functionality
DeskPlay is a playful desktop overlay app. It creates temporary visual, audio, and interactive effects on top of your desktop, such as confetti, bubbles, color effects, harmless critters, cookie crumbs, and small desktop toys.
DeskPlay does not permanently alter your files, desktop contents, system settings, applications, windows, or display hardware under normal operation.
The app is designed for harmless entertainment. It does not simulate device failure, cracked or broken screens, real system damage, or real-world consequences.
App behavior may vary depending on your macOS version, hardware, display setup, system configuration, permissions, accessibility settings, and other installed software.
4. User Responsibility
You are responsible for using DeskPlay safely and reasonably.
Do not use DeskPlay in situations where visual effects, sound, motion, or distraction could create risk, disruption, or discomfort, including while driving, operating machinery, giving presentations, participating in calls, or using someone else's device without permission.
DeskPlay is intended for entertainment purposes only and should not be interpreted as encouraging real-world actions, damage, disruption, or misuse.
5. No Warranty
DeskPlay is provided on an "as is" and "as available" basis, without warranties of any kind, except where warranties cannot be excluded under applicable law.
The developer does not guarantee that DeskPlay will be uninterrupted, error-free, compatible with all devices, compatible with all future macOS versions, or suitable for any particular purpose.
6. Limitation of Liability
To the maximum extent permitted by law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, goodwill, business opportunities, or other losses arising out of or related to your use of DeskPlay.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by applicable law.
7. Updates and Changes
The developer may update, modify, suspend, or discontinue DeskPlay at any time, with or without notice.
These Terms may also be updated from time to time. Continued use of DeskPlay after updated Terms take effect constitutes acceptance of the updated Terms.
8. Privacy
Your use of DeskPlay is also subject to the DeskPlay Privacy Policy.
9. Termination
These Terms remain in effect until terminated.
They will terminate automatically if you fail to comply with them. You may also stop using DeskPlay at any time by uninstalling the app.
Upon termination, your license to use DeskPlay ends.
10. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict of laws rules, unless mandatory consumer protection laws in your country of residence provide otherwise.
